WHEN THE INQUIRY ENDS BUT THE WORKPLACE FALLOUT CONTINUES

The inquiry may close, but workplace responsibility does not

A POSH inquiry may officially end with a report.

But that does not always mean the workplace situation ends there.

After the findings, there may still be awkwardness, strained relationships, gossip, isolation or changes in team dynamics.

What Happens After the Inquiry?

The parties may still have to work in the same organisation.

A complainant may feel uncomfortable returning to the same team.

A respondent may feel isolated, particularly where the allegations were not established.

Colleagues may also begin taking sides or discussing matters they should not be discussing.

This is where post-inquiry workplace management becomes important.

Confidentiality Does Not End With the Inquiry

The conclusion of the inquiry does not make its contents public.

Section 16 restricts publication or communication of the complaint, identities of the parties and witnesses, inquiry proceedings, recommendations and action taken under the Act.

Therefore, sharing allegations, statements, evidence or findings unnecessarily can create further harm and workplace conflict.

What Should the Organisation Do?

After the inquiry, the organisation should focus on:

  • implementing the recommendations arising from the inquiry;
  • maintaining confidentiality;
  • addressing any further misconduct or retaliation appropriately;
  • managing workplace disruption without disclosing confidential details; and
  • maintaining a safe and professional working environment.

The employer’s statutory duties do not disappear once the report is submitted. Section 19 requires the employer to provide a safe working environment, while Section 18 also provides an avenue of appeal against specified recommendations or non-implementation.

An Inquiry May End. Responsibility Doesn’t.

Closing a POSH inquiry is not simply about filing the report and moving on.

The organisation must also ensure that the workplace remains professional, safe and respectful, while maintaining the confidentiality required by law.

KEY TAKEAWAY

The conclusion of a POSH inquiry is not necessarily the end of the workplace issue.

The inquiry may close.

But confidentiality, implementation of the outcome and responsible workplace management continue.
